European Judges Reject Copyright Claim Over Football Fixtures

A claim for copyright over football fixture lists in England Scotland has been rejected by European judges.

European judges cited the need for “significant” work on compiling Football league fixtures, but did not entail the creativity required for copyright protection.

This comes after accusations were made at Yahoo, bookmaker Stan James and sports information firm Enetpulse of breaching EU copyright laws.

However, the Premier League said it was for national courts to rule whether or not copyright protection was afforded.

The league said it was confident that this hearing would go its way, and provide “database protection for the English and Scottish football leagues’ fixtures”. The final hearing will be in the UK in the near future.

Dataco, the firm responsible for protecting the rights acquired in English and Scottish football league fixtures, and said the trio of firms had breached copyright by failing to pay for the use of the match schedules.

Football Dataco grants licences to third parties allowing them – for a fee – to reproduce the Premier League, the Football League, Scottish Premier League and Scottish Football League fixtures.

Problems are raised when News and media services, as well as gambling firms, fantasy football operators and other commercial outlets, use the information to produce fixture information for fans and allow gamblers to bet on events.

The case had originated in the English courts, before being sent to the European Court of Justice for clarification of certain points of database law.

“A football fixture list cannot be protected by copyright when its compilation is dictated by rules or constraints which leave no room for creative freedom,” said the European judges.

The case was referred to the European court by the High Court in London, which must now “assess, in the light of the considerations set out by the [Luxembourg] court, whether the football fixture lists concerned are databases which satisfy the conditions of eligibility for copyright protection”.

LAFC and IBM sign stadium deal

MLS football (soccer) club Los Angeles FC (LAFC), have announced a stadium tech partnership with IBM.

For the 2018 season, ahead of LAFC’s MLS debut, the club will make use of IBM’s platforms and technologies to deliver a connected fan experience at the new 22,000-capacity Banc of California Stadium.

IBM is to provide Wi-Fi access using a fibre-based network throughout the stadium along with an enhanced digital experience, at an estimated cost of US$ 350 million.

The explosive growth of an immersive fan experience has elevated people’s expectations when they attend any large venue event,” said Peter Lorenzen, General Manager of Networking Services at IBM Global Technology Services. “Today, stadiums such as LAFC’s new facility are embracing new and innovative solutions that answer the call and in doing so are helping to re-invent the game-day experience.”

The soccer-specific stadium partnership in the MLS is a first for tech giants IBM.

Miami Dolphins sign Hard Rock stadium deal

The Miami Dolphins and Hard Rock International announced an 18-year agreement to name the newly renovated facility Hard Rock Stadium.

This venue will serve as the home of the Miami Dolphins, drugs University of Miami football team, rx Orange Bowl, medic Super Bowl LIV and the 100thanniversary of the NFL, international soccer and a host of events. Additionally, the iconic lifestyle brand becomes the official Miami Dolphins hotel and resort, casual restaurant partner and hospitality sponsor.

“Hard Rock Stadium will be a global entertainment destination and we are excited to enter this long-term partnership with Hard Rock International, an iconic worldwide brand that continues to grow,” Miami Dolphins President & CEO Tom Garfinkel said. “They are synonymous with music and entertainment and have a rich history of philanthropy and community engagement.”

In addition to hosting major events, Super Bowl LIV, College Football Playoff Semifinals and major concerts, it was announced that Hard Rock Stadium has secured rights to host the Brazil Men’s National Soccer Team for a series of matches starting in 2017. In addition, Real Madrid will be returning to Miami in 2017 to launch play in the International Champions Cup.  

As part of the partnership, the newly renovated Hard Rock Stadium will feature signage atop the shade canopy, at the facility entrance, on the VIP helipad as well as throughout the venue and organization. The main thoroughfare of fan activities pregame along the South Gate will be renamed the Grand Plaza presented by Hard Rock.

NBA team with Econet for African TV coverage

More FIFA Arrests Could Be Made, Warns US Attorney General Lynch

The US Attorney General Loretta Lynch has strongly suggested that a further wave of arrests in relation to the FIFA corruption scandal could come about.

Lynch was speaking in Zurich at press conference organised by the International Association of Prosecutors updating the world on the investigation by US authorities alongside Swiss Attorney General Michael Lauber.

In May, medicine 14 senior FIFA-linked officials were arrested in Zurich and Lynch that day revealed details of the fraud, anesthetist conspiracy and corruption charges against the charged men just days before Sepp Blatter was re-elected as FIFA president.

However, ambulance the impact of the scandal played a decisive role in his decision, only four days later, to announce his intention to stand down. A new president will be elected at an extraordinary congress on February 26.

Lynch said: “In the four months since May our work and the investigation has continued. Thirteen of the 14 defendants have been arrested either by us or by other authorities. Three have been arraigned in a federal court in Brooklyn; 10 others are pending extradition in Switzerland and three other countries.

“Our investigation is ongoing and has expanded since May. On the basis of new evidence we anticipate pursuing additional charges against individuals and entities.”

Lynch refused to comment on whether Blatter was one of those who could be charged in the future and extradited.

She said: “I have no comment on individuals who may or may not be subject to the next round of arrests so I cannot give you any information about Mr Blatter’s travel plans.”

However, she did have a stern warning about the need for urgent reform in the sport.

“The problem of corruption in soccer is global and we will remain vigilant,” Lynch said. “One hallmark has guided our work: all individuals involved in soccer, this beloved sport through which we teach sportsmanship, integrity and fair play, must be committed to reform and compliance with the rule of law.

“To anyone who seeks to live in the past, this global response sends a clear message: You are on the wrong side of progress and do a disservice to the integrity of this wonderful sport.”

Lauber confirmed that as part of the Swiss authorities investigation, which is not directly linked to the US one, assets had been seized including real estate in the Swiss Alps.

However, he would not reveal who they belonged to for “tactical reasons”.

Lauber also revealed that around 11 terabytes of data had been collected.

The investigations continue.

Japan Will Struggle to Meet IOC’s 2020 Stadium Deadline, Says Japan’s Olympic’s Minister

Japan’s Olympic’s Minister Toshiaki Endo has said the country cannot guarantee it will be able to meet the International Olympic Committee’s (IOC) deadline to finish work on a new National Stadium in time for the 2020 Olympic Games.

IOC vice-president John Coates has urged Japan to speed up construction work on the stadium for delivery by January 2020, which gives the country three months less time than the originally planned April 2020 handover.

Coates said he asked Japan’s senior Olympic officials to meet this deadline in order for the IOC to run a series of tests before the start of the Games in August 2020.

“The stadium has to be available for ceremonies and rehearsals,” Coates said.

“They need to have the handover to the organising committee by January 2020.”

However, Endo has insisted it may not be possible to meet this deadline as April was already a date they were struggling to fulfill.

“It was going to be April on a very tight schedule,” Endo said.

“I cannot easily say yes to January 2020. I can only ask contractors to finish the construction as quickly as possible. We have no idea if it’s doable.”
